JUDGES BENEFITS: AN OVERVIEW FOR SPOUSES

Carol S. Sefren, Chief of the Judges Compensation and Retirement Division of the Administrative Office of the United States Courts will be presenting an overview of benefits to spouses. Her presentation will include important benefits such as health and life insurance; the health and dependent care reimbursement accounts; the dental and vision plans; and the Thrift Savings Plan. She will discuss the impact of the Judicial Survivors’ Annuities System on surviving spouses and explain what spouses need to do to claim death benefits upon the passing of the judge. Ms. Sefren also plans to cover retirement issues, social security and medicare. She will provide materials to each participant and allow time for questions.

There are many laws and rules that govern what happens when an employee has or is perceived as having a disability or when an employee takes a leave or seems to be in need of taking such a leave. The Family and Medical Leave Act of 1993 has been in effect for over 26 years and must be considered when faced with an employee’s rights in leave scenarios --- but other statutes are also applicable. For example, employees may also be entitled to leave or a continuation of a leave as a reasonable accommodation under the Americans With Disabilities Act. The panel will discuss this interface/interplay between the ADA, FMLA and other employment laws which face employees, employers and, as a result, courts. The panel will analyze problem areas, provide strategic practices and discuss jurisprudential and legislative developments regarding these and other employment law issues.

This panel will discuss what implicit bias means and how it may unintentionally influence our personal and professional decisions in areas such as the jury selection process and the evaluation of witness testimony. A discussion of efforts to respond to possible implicit bias, including a courtroom bias video in use in the Western District of Washington, will be conducted. The discussion will also include the challenges faced by trial practitioners in identifying and responding to possible courtroom bias based on race, gender and/or nationality.
